These Terms and Conditions (“Terms”) govern your access to and use of the website, services and all related communications provided by American Innovation LLC (“Company,” “we,” “us,” or “our”), a California limited liability company operating under CSLB License #1103552.

By accessing our website, submitting a contact form, requesting an estimate, entering into a service agreement, or otherwise engaging with our Services, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy.

2. Description of Services

American Innovation LLC provides residential construction and home-improvement services, including kitchen, bathroom and interior remodeling, window and door replacement, plumbing, heating, ventilating and air-conditioning, and landscaping. Work is performed under the following classifications on CSLB License #1103552:

• B — General Building
• C-36 — Plumbing
• C-20 — Warm-Air Heating, Ventilating and Air-Conditioning
• C-27 — Landscaping

Trades not covered by our license, such as line-voltage electrical work or roofing, are performed by appropriately licensed subcontractors. Service descriptions, estimates and project scopes on our website are for general informational purposes only and do not constitute a binding offer.

3. Website Use

3.1 Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts.

3.2 Permitted use

You agree to use our website only for lawful purposes. You may not submit false information, attempt to disrupt or gain unauthorized access to the site, scrape its content, or use it to send unsolicited commercial messages.

3.3 Intellectual property

All content on our website, including text, layout, logos, graphics and photographs, is the property of the Company or its content providers and is protected by copyright, trademark and other intellectual property laws. You may not reproduce it without our written permission.

3.4 Photographs

Photographs on this site illustrate the type of work described. Unless a page identifies a photograph as a specific completed American Innovation project, it is illustrative and does not depict a particular job, result or timeline.

4. Estimates, Quotes and Contracts

Estimates are free and carry no obligation. Written quotes are valid for thirty (30) days unless otherwise stated. No work shall commence until a written contract has been signed by both parties and any required deposit has been received. The signed contract governs the scope, price and schedule of the work; where it conflicts with anything on this website, the contract controls.

Changes to the agreed scope are made only through a written change order approved by you before the additional work is performed.

5. Communications and TCPA Consent

5.1 Consent to communications

By providing your telephone number and submitting a form on our website, you provide express written consent under the Telephone Consumer Protection Act (TCPA) to receive from us and our authorized agents:

American Innovation LLC holds CSLB License #1103552, is bonded, and carries workers’ compensation insurance. You may verify our license status at any time at www.cslb.ca.gov.

7. Warranties and Disclaimers

7.1 Service warranty

Any warranty on workmanship or materials is set forth in the individual project contract. Residential construction is subject to the standards and rights provided by California Civil Code § 896 et seq.

7.2 Website disclaimer

THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR THE SERVICES. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER CALIFORNIA LAW, INCLUDING RIGHTS UNDER A SIGNED HOME IMPROVEMENT CONTRACT.

You agree to indemnify and hold harmless the Company, its members, employees and agents from any claims, damages or expenses arising from your violation of these Terms or your misuse of the website.

10. Third-Party Links and Services

Our website may link to third-party websites, such as social media profiles or the CSLB register. We are not responsible for the content or privacy practices of those sites.

11. Dispute Resolution

11.1 Governing law

These Terms are governed by and construed in accordance with the laws of the State of California.

11.2 Informal resolution

The parties shall attempt in good faith to resolve any dispute informally for a period of thirty (30) days before pursuing formal proceedings.

11.3 Jurisdiction

Subject to any dispute-resolution provision in a signed project contract, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.

11.4 CSLB complaint rights

You may file a complaint with the Contractors State License Board by calling 1-800-321-CSLB (2752) or visiting www.cslb.ca.gov.

12. California-Specific Disclosures

• Business and Professions Code § 7159: home improvement projects over $500 require a written contract containing the notices prescribed by law.
• Business and Professions Code § 7159.5: the down payment on a home improvement contract may not exceed $1,000 or 10% of the contract price, whichever is less.
• Civil Code §§ 1689.5–1689.14: you have a three (3) business day right to cancel a home solicitation contract; notice of this right is provided with the contract.
• Civil Code § 8200 et seq.: a mechanics lien warning and preliminary notice are provided with the contract as required by law.

13. Force Majeure

The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, fire, flood, pandemic, labor disputes, material shortages, utility outages or government actions.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any individual project contract, constitute the entire agreement between you and the Company regarding the website and the Services.

16. Modifications

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the website with a revised effective date. Continued use of our Services after changes constitutes acceptance of the updated Terms.
